Rhode Island Department of Elementary and Secondary Education PUBLIC NOTICE OF PROPOSED RULEMAKING

 Pursuant to the provisions of Chapter 23-24.6 of the General Laws of Rhode Island, as amended, and in accordance with the Administrative Procedures Act, Chapter 42-35 of the General Laws, the Rhode Island Department of Elementary and Secondary Education (RIDE) hereby gives public notice of proposed rulemaking on the Proposed Regulations Governing Protections for Students Rights to be Free from Discrimination on the Basis of Sex, Gender, Sexual Orientation, Gender Identify, or Gender Expression. 


The proposed regulation requires school districts to adopt a policy by July 1, 2018, to ensure that transgender and gender non-conforming student are free from discrimination.  This regulation can also be viewed on the Secretary of State’s website.

 

All interested parties are invited to provide written or oral comments concerning the proposed regulation from January 12, 2018 - February 16, 2018 to:

In accordance with R.I. Gen. Laws § 42-35-2.8, an oral hearing will be granted if requested by twenty-five (25) persons, by an agency or by an association having at least twenty-five (25) members. A request for an oral hearing must be made within thirty (30) days of this notice.

 

In the development of the proposed regulation consideration was given to: (1) alternative approaches; (2) overlap or duplication with other statutory and regulatory provisions; and (3) significant economic impact on small business. No alternative approach, duplication, or overlap was identified based upon available information.

 

The costs of the regulation are minimal when balanced against the need to ensure that gender non-conforming and transgendered individual rights are protected in schools.
